Returns and withdrawal from the contract
1. Right of withdrawal from the contract
A Consumer who has concluded a distance sales agreement in the Store may withdraw from it without giving a reason within 14 days.
In the case of the sale of a single item, the period runs from the day the Consumer or a third party designated by them other than the carrier takes possession of the goods. If an order covers multiple goods delivered separately, in batches, or in parts, the period runs from taking possession of the last item, batch, or part.
To meet the deadline, it is sufficient to send the statement of withdrawal before its expiry.
2. How to submit the statement
The statement may be sent to the e-mail address lp.netram@oruib or by post to: MARTEN TRADE sp. z o.o., ul. Nowowiejska 1, 57-160 Borek Strzeliński. The Consumer may use the form included at the end of this document, but this is not mandatory.
3. Returning the goods
The goods should be returned to: MARTEN TRADE sp. z o.o., ul. Nowowiejska 1, 57-160 Borek Strzeliński, without delay and no later than 14 days from the date the statement of withdrawal was submitted. The deadline is met if the goods are dispatched before it expires.
The Consumer bears the direct cost of returning the goods. The goods should be adequately secured for transport.
4. Condition of the returned goods
The Consumer may use the goods only to the extent necessary to establish their nature, characteristics, and functioning, in the same way as they could in a brick-and-mortar store. The Consumer is liable for any diminished value of the item resulting from using it beyond that extent.
The original packaging is not a condition for exercising the right of withdrawal; however, it is recommended to use packaging that ensures safe transport.
5. Refund of payments
In the event of an effective withdrawal, the Seller refunds to the Consumer all payments received from them, including the cost of delivering the goods to the Consumer up to the amount corresponding to the cheapest ordinary delivery method offered by the Store.
The refund will be made without delay and no later than 14 days from receipt of the statement of withdrawal. The Seller may withhold the refund until the goods are received or proof of their return is provided, whichever event occurs first.
The refund will be made using the same payment method that the Consumer used, unless they expressly agree to a different method of refund at no cost to them.
6. Entrepreneur with consumer rights
The rights relating to withdrawal from the contract also apply to a natural person entering into a contract directly related to their business activity, where it is clear from the content of that contract that it is not of a professional nature for that person, resulting in particular from the subject of the business activity carried out.
Other entrepreneurs are not entitled to the statutory right of withdrawal without giving a reason. A return in such a case requires the Seller’s individual consent.
7. Model withdrawal form
The form may be used optionally. The completed document should be sent to the Seller’s address or by e-mail.
